1.1 Overview

This policy governs access and use of the TikTok Shop Partner Center Platform ("TTSPC"), and applies to any user of the TTSPC platform ("Partner"), including with respect to the marketing, advertising and offering of any services and/or products on the TTSPC.

  • Create a positive service subscription environment on the TikTok Shop Service Market ;
  • Provide a reliable subscription experience to merchants who subscribe to the service.

All partners selling services through the TikTok Shop Service Market must operate under our guidelines.

§3 1.2 Scope

1.2 Scope

The Violation Management Regulations for TikTok E-Commerce Partners covers the service release requirements for partners with respect to the marketing, advertising and offering of any services and/or products on the TTSPC. IMPORTANT: Partners ensure that TikTok Shop Partner Center listings, TikTok Shop Service Market sales and services provided comply with applicable laws and regulations. Our guidelines are intended to facilitate compliance by partners. They are not exhaustive and are not intended to serve as legal advice. If partners have questions about the laws and regulations of their products, we encourage partners to seek independent legal advice. Our guidelines are regularly updated. It is the service partner's responsibility to check this page regularly to ensure they are adhering to our current guidelines.

§4 II. Definitions

  • Partners means any company, person, user, individual or other entity that sells services and services on the TikTok Shop Service Market .
  • The capitalized terms contained in this policy shall have the meaning set forth in our TikTok Shop Partner Center Terms of Service.

§5 III. Management of Violation Points

III. Management of Violation Points

  • The TikTok Shop adopts a violation point-based management mechanism for partners' violations. After TikTok Shop determines that a partner has violated the rules (in its absolute discretion), the corresponding points will be issued based on the severity of the violation. TikTok Shop reserves the right to take corrective action for any violation of the TikTok Shop Partner Center Terms of Use, including but not limited to removal of a partner and its services. When the points of a partner reach a certain level, determined in TikTok's sole discretion, TikTok is guaranteed to take corrective action against the partner.This is without prejudice to any other rights and remedies that may be available to TikTok Shop for your violation of these rules, or any other TikTok Shop terms or policies."
  • The initial violation points of a partner is 0 point and the upper limit is 120 points, which are cleared on the 180th day (30 June at 23:59:59 GMT+8) and the last day (31 December at 23:59:59 GMT+8) of each calendar year.
  • Enforcement measures for different levels of violation points are shown below:

Remarks1. If the accumulated points are more than 90, the partner must provide a description of the situation and a rectification report within the service suspension period after receiving the point notice. If the information is not provided or the information is unqualified, the platform has the right to continue deactivating all the services for the partner. 2. Partners who are issued 120 points for a single violation will be removed and added to the blacklist, and their violation points will not be cleared. The platform reserves the right to "blacklist" partners and publicize them on the Service Market.
  • Based on the severity of violations, we may take action in addition to the necessary corrective actions. These measures include suspending and/or terminating your access and use of the TTSPC, including the advertising, marketing and/or offering of any of your services and/or products on the TikTok Shop (in each case, in whole or part). A non-exhaustive list of additional actions we may take is included below:
  • Limit Available Services , which means partners are not allowed to sign up for any ad resources or other recommended activities, but this does not affect their presence on TikTok.
  • Partner termination, which means the partner is removed from the Service Market, and all services under the partner's name are deactivated. All TikTok API calls of its services (if any) are stopped; the terminated partner is permanently prohibited from re-entering the Service Market.
  • Actions for other accounts of the partner, TikTok Shop has the right to impose the same actions on other accounts of the partner based on the severity of the violation.
  • Freeze and deduct commissions and fees derived from policy violations or frauds conducted by the partner or by others in its network (such as sellers or creators).

[Violation behaviors] The onboarding and business documents provided by the partner involve falsified information, which is found during moderation (including but not limited to onboarding moderation and review) or reported by others. These violation behaviors include but are not limited to:

  • Providing fraudulent company registration certificates.
  • Providing fraudulent company information.
  • Failing to provide true and valid identity information of merchants/partners/creators.
  • Failing to sign true and valid contracts with creators/merchants/enterprises.
  • Submitting other fraudulent documents required to be reviewed during onboarding.
  • Fraudulent test results, including but not limited to communicating with merchants for product exchange, disclosing test items in advance, issuing qualified reports without testing and making promises about test results

[Enforcement]:

  • 120 points are issued for each violation.

1.2 Incomplete information

[Violation behaviors] The onboarding documents provided by a partner do not meet the requirements of TikTok Shop, which is found during moderation (including but not limited to onboarding moderation and review) or reported by others. These violation behaviors include but are not limited to:

  • Failing to provide complete company registration certificates.
  • Failing to provide complete information of business size.
  • Failing to provide trademark/patent certificates or other qualification documents required by TikTok Shop from time to time.
  • Failing to provide identity information of merchants/partners/creators required by TikTok Shop from time to time.

[Enforcement]:

  • 30 points are issued for each violation.

§10 1.3 Not meeting the entry criteria

1.3 Not meeting the entry criteria

[Violation behaviors] The qualification of a partner does not meet the platform onboarding standards, which is found during moderation (including but not limited to onboarding moderation and review) or reported by others. These violation behaviors include but are not limited to:

  • Failing to provide additional documents required by the platform to substantiate compliance with onboarding standards after they are updated.
  • Repeated onboarding: the same entity onboarded more than once of the same service provider type.
  • Having been terminated by other platforms.

[Enforcement]:

  • 120 points are issued for each violation.

§11 1.4 Not updating the business information in a timely manner

1.4 Not updating the business information in a timely manner

[Violation behaviors] During its application for entry into TTSPC and its operation in TikTok Shop Service Market, a partner fails to update the platform on any changes of its business information within 30 days after the changes. These violation behaviors include but are not limited to:

  • Failing to update company registration certificates in the case of any changes.
  • Failing to update business address in the case of any changes.

[Enforcement]: 30 points are issued for each violation.

[Violation behaviors] Any improper, harmful, illegal or malicious acts, including but not limited to: including but not limited to:

  • A partner pays bribes to employees of ByteDance (including partner shareholders, directors, supervisors, senior managers and the active staff) or commit acts in violation of the Code of Conduct of ByteDance Business Partners.
  • The existing interests between agencies and merchants have not been reported, and their services have been facilitated.
  • A partners uses bribery, fraud and other illegal means to obtain operational resources and business opportunities. A partners uses bribery and other means of benefit transfer to improperly obtain operational resources and business opportunities.
  • Use of the TTSPC to cause harm to any third party. [Enforcement]:
  • 120 points are issued for each violation.

§14 2.2 Tax violations

2.2 Tax violations

[Violation behaviors] Acts that violate, or may violate, any applicable tax laws and regulations or lead to damage to users or TTSPC, including but not limited to:

  • A partner refuses to provide or fails to duly provide valid invoices or receipts to TTSPC users (i.e. the payer).
  • A partner commits or is suspected of committing tax evasion, tax fraud, invoice fraud, or other tax violations during their use of TTSPC.

[Enforcement]:

  • For minor circumstances, 30 points will be issued for each violation.
  • For general circumstances, 60 points will be issued for each violation.
  • For serious circumstances, 120 points will be issued for each violation.

2.3 Undue profits

[Violation behaviors] Acquiring benefits fraudulently, which is detrimental to users or the platform. Examples are: fraudulent activity and misleading merchants/creators, acquiring platform incentives by dishonest means, abnormal invitation of tender, treating merchants differently to gain profits and forcing them to buy services. [Enforcement]:

  • For general circumstances, 30 points will be issued for each violation.
  • For serious circumstances, 60 points will be issued for each violation.
  • For particularly serious circumstances, 120 points will be issued for each violation.

[Violation behaviors] A partner conducts authorised business in violation of rules. These behaviors include but are not limited to:

  • Claiming to be a partner/brand partner/regional partner/partner a certain type without or beyond the scope of authority (For example, an MCN/CAP partner pretends to be a TSP partner).
  • Production of fake licences and promoting or profiting from them.
  • After withdrawing from being a certain type of partner, still using its name or previous cases to continue recruiting merchants or operating services.
  • An agent or a partner fraudulently use official names, fake licensing or other means to collect fees, build cooperation, recruit merchants, etc.
  • Production of fake/fraudulent licences/documentation/unofficial issuance of licences, and using them for promotion, such as publicity and campaigns or other monetisation.
  • Unauthorized transfer or use of licences.
  • After withdrawing from being a partner, still using its partner licence to engage in activities, publicity and distribution, etc.
  • A partner carries out activities such as product promotion in the name of the platform or regarding the platform without or beyond the scope of authority.

[Enforcement]:

  • For serious circumstances, 60 points will be issued for each violation.
  • For particularly serious circumstances, 120 points will be issued for each violation.

3.1 False advertising / exaggerated promises

[Violation behaviors] A partner transmits content which contains false information, misdescribes facts, exaggerates, or overpromises, or commits other acts which can cause misunderstanding; or a partner conducts or assists in false advertising or other deceptive and misleading behaviors that violate the advertising laws, including but not limited to:

  • Display of unapplied shop/creator accounts as success stories, fraudulent use of success stories in communication with merchants/creators and promises that cannot be fulfilled; giving description that contains false qualifications and false capabilities/services (e.g. failing to provide short video filming services as advertised), services are falsely claimed to be free of charge, and other situations that violate relevant laws and regulations such as advertising laws (including but not limited to service and detail description which contains absolute terms)
  • Giving false advertising and exaggerated promises in the process of merchant recruitment or operation.
  • False promises about granting certain permissions, etc.
  • False promises about traffic support, etc.
  • The service functions described in the service title, detail page, internal pop-up banner, publicity banner and other spaces are inconsistent with the actual service provided, or the information is false or exaggerated.
  • Giving false advertising and exaggerated description, or abusing promises or overpromising about the functionality.
  • Advertising on behalf of merchants who have not subscribed to the service.
  • Making false promises about category service capabilities that the partner does not actually have.
  • A partner makes exaggerated promises of the results.
  • Giving false advertising and exaggerated promises of the service results, causing complaints of merchants.
  • Conducting or assisting in false advertising or other deceptive and misleading behaviors that violate the advertising laws.
  • Using absolute terms when advertising service products.

[Enforcement]:

  • For general circumstances, 20 points will be issued for each violation.
  • For serious circumstances, 60 points will be issued for each violation.

4.1 False/fraudulent transactions

[Violation behaviors] False/fraudulent transactions, including but not limited to:

  • Earning incentive fees through false transaction behaviors abusing campaign incentives, partner incentives, etc.
  • A partner helps merchants with false transactions, publicly charges fees for the help and promotes the help.
  • A partner hires companies to use false transactions to improve its experience scores .
  • False transactions maliciously made by competitors; e.g. malicious order brushing of viral products of competitors.
  • False transactions of creators or celebrities; e.g. false transactions of fans and brokerage companies.
  • False transactions of the Service Market orders.
  • A partner conducts improper profit-making services, such as follower boosting and order brushing.
  • Using order brushing to drive the scores in the Service Market.
  • TikTok has sole discretion in determining false/fraudulent transactions.

[Enforcement]:

  • For general circumstances, 30 points will be issued for each violation.
  • For serious circumstances, 60 points will be issued for each violation.
  • For particularly serious circumstances, 120 points will be issued for each violation.

[Violation behaviors] Based on the comprehensive judgement of TikTok, there are reasons to believe that a partner has no intention to perform the contract and is suspected of illegally obtaining other people's property and infringing on other people's property rights for the purpose of gaining illegal profits. [Enforcement]: 120 points will be issued for each violation.

[Violation behaviors] The services displayed in the showcase or LIVE are completely different from the actual services received by merchants. [Enforcement]:

  • For general circumstances, 30 points will be issued for each violation.
  • For serious circumstances, 60 points will be issued for each violation.
  • For particularly serious circumstances, 120 points will be issued for each violation.

§24 5.1 Information leakage

5.1 Information leakage

[Violation behaviors] All partners leak information(sharing confidential information, commercially sensitive information, personal data etc.) of the platform or other parties, including but not limited to:

  • Including but not limited to the leakage of data to third parties without the authorization of the platform, the leakage of business data to other entities without the authorization of the merchants and the leakage of users' personal information without the authorization of the platform users, causing the risk of leakage of confidential matters.
  • Leakage of key business information(GMV data etc.), sharing key business information in public without the authorization of the platform, including but not limited to accepting interviews with the media, consulting companies, other third parties, etc.
  • A partner collects, displays, discloses, uses or authorizes others to use the service operation data without authorization. Such service operation data include but are not limited to personal data such as user name, mobile phone number, address, transaction data, interface data and other service usage data.
  • A partner mistakenly transmits a full report which contains test items and standards that must not be transmitted to external parties, resulting in the leakage of project standards.
  • A partner leaks information of product test items, warehouse and factory inspection standards and passing standards which are unpublicized to merchants to influence them to place orders.
  • A partner is reported by an external party and verified to have conducted data leakage behaviors.
  • A partner illegally uses third-party softwares with Trojans implantation, resulting in the leakage of business/consumer information.
  • A current or former employee of a partner is reported to have misused or leaked merchant/consumer information.
  • Privately developing batch decryption tools for merchants without the permission of or reporting to the platform, resulting in consumer information leakage .
  • TikTok has sole discretion in determining false/fraudulent transactions.

[Enforcement]:

  • 120 points will be issued for each violation.

5.2 Data security

[Violation behaviors] All partners commit acts which undermine platform data security, including but not limited to:

  • A partner collects TikTok Shop or the Service Market account numbers, passwords, or other ID credentials of merchants.
  • A partner collects data beyond the authorization of merchants and the Service Market or takes any technical measures to obtain data from TikTok Shop and the Service Market/the open platform without express authorization.
  • A partner saves, displays, aggregates (data of multiple merchants and stores, for example), leaks, uses or authorizes others to use the service operation data without authorization. Such service operation data include but are not limited to personal data such as user name, mobile phone number, address, industry data, transaction data, interface data and other service usage data.
  • A partner's application includes obtaining and analyzing data of the platform, merchants or consumers and has caused negative impacts on the platform, merchants or consumers.
  • A partner improperly discloses the user data it obtains to any third party.
  • A partner's application includes the function of obtaining and analyzing information and industry intelligence such as business data or consumer personal data.
  • A partner fails to rectify under the relevant requirements of TikTok Shop such as security capabilities, security risks and timely security response.
  • The platform detects sensitive API calls, but the partner fails to truthfully report the sensitive information requests—a case of subjective omission and concealment of API logs.
  • Subjectively concealing and clandestinely developing batch export function of plain text information.
  • Clandestinely storing private data of the platform's merchants and consumers in plain text in violation of the platform rules.
  • A partner clandestinely use technical means to call the platform's decryption APIs through regular polling without authorization to illegally obtain private data of consumers of the platform.
  • TikTok has sole discretion in determining false/fraudulent transactions.

[Enforcement]:

  • 120 points will be issued for each violation.

5.3 Application security violations (including improper APIs)

[Violation behaviors] All partners commit acts that violate the platform application security, including but not limited to:

  • Collecting data by obtaining merchants' login status with the TikTok Shop account and password login function embedded in the application.
  • The partner leaks sensitive information such as high-risk ports, management APIs or source code directories of the application system to external parties.
  • Behaviors that actively endanger system security, such as account privilege escalation and backdoor program installation, appear in the partner's application.
  • The partner's application interferes or attempts to interfere with the proper functioning of the open platform, other partners' applications or any part or functionality thereof.
  • The partner's application system has security bugs that can cause data leakage and are not fixed in time (such as direct or indirect support for plug-ins and crawling for order information/chat history).
  • The partner's application is not upgraded or modified based on the relevant security requirements of the platform. The submitted information for review is untrue and incomplete (including but not limited to failing to complete security-related upgrades of the application under the platform announcement). Failing to disclose the whole set of shared data of a single application such as its web application, servers and databases to the platform when applying for security access.
  • Failing to complete safety-related upgrades or risk rectification within the specified time limit under the platform's safety-related regulations.
  • The partner fails to rectify under the relevant requirements of TikTok Shop platform notification such as security capabilities, security risks and timely security response.

[Enforcement]:

  • 120 points will be issued for each violation.

6.1 Posting prohibited and sensitive information

【Violation behaviors】 Partners threaten the security of the platform and put TikTok Shop at risk. These behaviors include but are not limited to:

  • Political risk: Involving politically sensitive, ethnic, military, diplomatic, or historical figures.
  • Sensitive topics: Discriminatory, offensive remarks concerning race, colour, religion, etc.
  • Partners use the words "TikTok Shop" in any way that infringes on the rights of third parties or violates the law.

【Enforcement】

  • 120 points will be issued for each violation.

6.2 Unfair competition

【Violation behaviors】 Partners act in violation of competition law or disrupt the service market by acting in an unfair or malicious manner. These behaviors include but are not limited to:

  • Partners disparage others and spread false information about them to damage their rights and interests.
  • Partners deceive, induce or force merchants to use its service only but do not provide services afterwards. Partners do not end the partnership even after being reported/complained about.
  • Partners form a partnership with creators/merchants without consent and do not end it even after the creators/merchants have provided evidence of the unauthorised binding.
  • partners attempt to negatively impact other partners, such as plagiarism.
  • To attract merchants to place orders in the service market, partners lower the testing standards to increase the test pass rate.
  • Other practices of unfair competition.

【Enforcement】

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

§31 6.3 Promotion in the name of TikTok

6.3 Promotion in the name of TikTok

【Violation behaviors】 Partners use the name/logo of TikTok.These behaviors include but are not limited to:

  • Partners promote themselves in the name of TikTok or use the name/logo/template/signal.
  • Partners promote themselves in the name of an invalid official event/product.
  • Partners pretend TikTok ( including use the name/logo/template/signal ) or their staff pretend to work at TikTok, when they recruit creators or cooperate with merchants.
  • Partners use the name and logo of the platform and its affiliates.
  • Partners use official or suggestively official expressions or logos on the primary image, title, or product detail page of the service description.
  • TikTok has sole discretion in determining false/fraudulent transactions.

【Enforcement】

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

【Violation behaviors】 Partners have the intention to circumvent or have already circumvented the platform managements(Platform rules and Operations). These behaviors include but are not limited to:

  • Partners or their staff do not fulfil their regulatory requirements and assist or allow the merchants to circumvent platform managements.
  • Partners introduce or cooperate with unauthorized quality assessment agencies and provide services for them without the authorization and permission of the platform.
  • Other behaviors aiming to circumvent platform management.

【Enforcement】

  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

6.5 Harrassment

【Violation behaviors】 Partners use uncivil language to harass, defame, denigrate or abuse users/platform staff. Or, partners use irritating words or phrases to abuse others or harm their legitimate rights and interests. These behaviors include but are not limited to:

  • Partners harass brands or merchants who have already onboarded TikTok e-commerce by requesting to establish a service marketplace partnership .
  • Partners harass, insult, threaten, and intimidate merchants or creators or give them unfounded negative reviews for retaliation.
  • Partners interrupt others' every day lives, causing physical or mental harm or bad influence .
  • Partners send a large number of spam messages (e.g. unknown verification codes) to others by phone, SMS, email, etc., and contact others frequently.
  • Partners repeatedly contact others late at night or in the early morning hours, causing inconvenience to others.
  • Partners insult or threaten others through phone calls, SMS, emails or comments or send repugnant items to others.
  • Partners abuse platform staff verbally or in writing.

【Enforcement】

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

6.6 Manage accounts improperly

【Violation behaviors】 Partners manage accounts improperly. These behaviors include but are not limited to:

  • Partners apply, transfer, lend, rent or disclose application and service accounts to any third parties without the platform's permission.
  • Partners steal others' accounts or infringe on others' rights to physical safety and to property.
  • Partners have their accounts stolen due to improper management, causing adverse impact on platform users.
  • Partners apply, lend, sell or transfer application and service accounts on behalf of others without the permission of the platform or the owner of the account being handled by the Partner.

【Enforcement】

  • 120 points will be issued for each violation.

【Violation behaviors】 Partners induce/abet merchants or creators to break the rules. These behaviors include but are not limited to:

  • Partners assist or guide merchants to violate platform rules.

  • If the circumstances are particularly serious, 120 points will be issued for each violation.

6.8 Improper use of the rights of others

Violation behaviors 】The service information published by partners or the service provided by the partners improperly uses other people's trademark rights, copyrights, patents and other rights. It includes but is not limited to the following scenarios:

  • Use success stories of other partners for publicity.
  • The names, nicknames, avatars, logos, slogans, products, etc. used by the partner are acts of impersonating the identity of others and infringing on the legal rights of others.
  • The content provided by partners involves plagiarism or other acts that infringe on other people's intellectual property rights or other legal rights.

【Enforement】:

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

【Violation behaviors】 Partners publish functions and services that are not supported by the platform for sale through the platform, including but not limited to the following scenarios:

  • Application functions or partners damage the rights and interests of users, or provide convenience or assistance for others to damage the rights and interests of users. Examples include software that can steal pictures/videos from other stores; recording the livestream from other stores and using it for your own store.
  • Features that disturb users or affect users' browsing path.
  • Image storage services, or services that extract image links on product detail pages and replace them.
  • The partner conducts illegal profit-making services, such as order brushing, buying followers, etc.
  • There are links to other websites in the front-end module, or the store page automatically jumps to somewhere else without any operation. The front-end module does not provide the function for merchants to directly delete or uninstall the code.
  • The application contains relevant links or instructions that inform or induce users to log in, register and use other platforms other than TikTok Shop cooperated platforms.
  • Direct users off TikTok Shop and its cooperative platforms to complete ordering and transactions, or provide services with such potential risks, i.e. transaction security risks or user data leakage.

【Enforcement】

  • For general circumstances, 30 points will be issued for each violation.

10.1 Failure to deliver services as agreed

【Violation behaviors】 The partner fails to provide the promised service to the merchant under the agreement made between the partner and the merchant, impairs the rights and interests of the merchant, or enters a dispute with the merchant/creator due to unfair or improper terms, and the disputes caused cannot be resolved, resulting in negative influence. It includes but is not limited to the following scenarios:

  • After the merchant/creator and the partner sign or reach a cooperation agreement, the partner fails to fully perform the services in the agreement, or the service quality does not meet the agreed standards, or the merchant/creator cannot contact the partner, or the partner terminates service for no reason (the agreement does not allow termination for convenience).
  • After terminating the cooperation agreement according to the conditions stipulated in the agreement signed by the merchant/creator and the partner, the partner refuses to perform the post-termination obligations, such as: refunding the merchant/creator, returning the store to the merchant/creator (including but not limited to returning account operation access) .
  • After the merchant/creator and the partner reach a cooperation agreement, the partner fails to provide services under the promised service content ( promise includes: paper contracts, email correspondence).
  • The service partner has not completed cooperation agreement, or written commitment, including: permissions (such as store backend operation permissions, data viewing permissions, etc.) have not been returned to the merchant/creator, and data (such as merchant/creator data during the cooperation period) has not been returned to the merchant/creator.
  • Failure to integrate key capabilities of the open platform within the specified time as required by TikTok Shop.
  • Due to service fulfillment problems, the merchant was punished by TikTok Shop or samples got lost, etc.
  • For testing items with a fixed testing time limit, the feedback times out, resulting in the delay of the merchant's onboarding process.

[Violation behaviors] The software or services provided by partners stop for non-platform reasons. This type of violation behaviors include but are not limited to:

  • Service was temporarily interrupted due to a system upgrade, computer room adjustments, line switching, etc. Partners interrupt the service without prior notice to the user on the service page three days in advance.
  • Partners close the software/suspend the service in advance without the consent of the merchant.
  • Partners have stopped their services, or we judge that they are not actually providing services.

[Enforcement]:

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

10.4 Negative after-sale

[Violation behaviors] Partners reject, do not respond, respond over time, or do not handle service improvement suggestions without viable reasons when dealing with the after-sales requests of merchants and creators. These behaviors, deemed by the platform at TikTok's sole discretion as the partners' fault, include but are not limited to the following scenarios:

  • Partners don't provide after-sales service: No or non-compliant after-sales services.
  • It is found that the partners' contact information is invalid or their phones are shut down. Or response timeout three times/reject phone call/do not provide after-sales services.
  • Failure to deal with merchant complaints promptly for more than five days, or failure to respond to feedback from merchants and platforms for more than two days.
  • Users complain about partners, and the platform becomes aware: more than three times per month.
  • Partners do not correct their behaviors one month after receiving the warning of violations.
  • Partners refuse to provide services for merchants and give no feedback after receiving warnings.
  • Partners are involved in a refund dispute. The circumstances are severe, and partners do not respond to the issue promptly.
  • Partners fail to handle customer complaints properly, resulting in an escalation of public rhetoric and spillover effects.

[Enforcement]:

  • For general circumstances, 30 points will be issued for each violation.
  • If the circumstances are serious, 60 points will be issued for each violation.
  • If the circumstances are particularly serious, 120 points will be issued for each violation.

§52 10.5 Failure to meet platform operation requirements

10.5 Failure to meet platform operation requirements

[Violation behaviors] Partners fail to meet the operational capability requirements of the platform, providing poor service or being unable to fulfil the duties of the contract. This type of violation also refers to cases where partners and their affiliates severely violate rules in other business modules of ByteDance or are penalized by judicial authorities. Including but not limited to:

  • Partners do not meet the platform's operational metric requirements.
  • Partners do not attend necessary training as required by the platform.
  • Partners do not meet or are considerably lower than expectations.
  • The person in charge can not be contacted for 30 days, and there are significant problems or stagnation in partners' internal cooperation and operation.
  • Partners violate contracts and do not go LIVE or perform poorly.
  • Products are of poor quality.
  • Partners fail to update and submit the latest qualifications as required by the platform.
  • Partners do not fulfil the cooperation agreement signed with the merchants/creators or get involved in disputes with creators and cause a negative impact for being unfair, containing unfair requirements in contracts, or failing to resolve issues promptly.
  • Partners do not manage signed creators properly as required by policies including but not limited to TikTok Shop Creator Performance Evaluation Guidelines, and TikTok Shop Content Guidelines.
  • Partners promise to participate in marketing events but withdraw without permission.
  • Partners provide poor services in areas such as properties, training, business consulting, quality inspection and logistics, and market-oriented services.
  • Partners do not manage their agents properly (e.g. Agents infringe upon other's rights or violate laws and regulations).
  • Partners provide invalid contact information, respond passively, and do not provide relevant materials as required in the case of an administrative investigation or legal proceedings.

[Enforcement]: For general circumstances, 30 points will be issued for each violation. If the circumstances are serious, 60 points will be issued for each violation. If the circumstances are particularly serious, 120 points will be issued for each violation.

§53 Appeal

Appeal

  1. If partners believe that an enforcement action has been taken against them in error, they may file an appeal within seven days of receiving the violation notice from email(tts.partner.warning@tiktok.com). Otherwise, it will be deemed that the partners approve the enforcement. The platform will review the appeal and tell the partners the results of receiving the appeal.
  2. An appeal raised by partners does not affect the validity, execution and publicity of the decision already made by the platform. Only when an appeal is successful will we remove any corrective actions issued.
  3. Partners can refer to the violation notice to choose the correct appeal channel. (email:tts.partner.appeal@tiktok.com).

1)The subject of the email must include the following: Partner ID + Order ID + [Appeal] 2)The content of the email must include the following: ① Partner ID, Order ID (text); ② Violation ID + Violation reason; ③ Appeal reason and relevant materials, including but not limited to chat records, screenshots, links, photos, recordings, etc.

§54 Appendix

Appendix

  1. These rules will become effective on December 10, 2022.
  2. The platform will sample the services provided by partners from time to time. If the partners and their services violate the rules, the platform will take enforcement actions accordingly. Meanwhile, the platform will suspend all online operational and promotional resources and give a public warning. Only when partners have corrected all the violation behaviors and the period of corrective actions ends can they resume regular operation.
  3. The platform manages and takes enforcement actions against all accounts and services of partners. If the same identity authentication information is used or the actual controller of multiple accounts is determined to be the same person after investigation, they are all regarded as the same partner. If partners and their services violate the rules, the platform reserves the right to take enforcement actions of the same severity on all the accounts and services of the same partner.
  4. The determination and handling of violations shall be based on the evidence of violations or the facts determined by the platform (the platform has the right to adjust the enforcement actions in light of the actual situation).
  5. If more than one violation is found, the platform will penalize the more severe violation. It does not mean that the partner has only one violation.
  6. If the partner violates the rules again or repeatedly, the platform may take multiple enforcement actions based on the rules the partner has violated and the number of violations.
  7. Partners must abide by national laws, administrative regulations, departmental rules and other normative documents. These rules apply to any suspected violations covered. TikTok reserves the right to deal with violations not included at its discretion. However, TikTok's enforcement actions on partners do not exempt them from legal liabilities. Partners must always abide by TikTok's guidelines and their affiliates' agreements.
